Biography

Born September 7, 1927, in Bani, Dominican Republic.

Areas of Practice

Juan Manuel Pellerano concentrates his law practice in corporate litigation, Constitutional law, business law, admiralty and maritime law, and insurance, telecommunications, and banking law.

Experience

In 1952, Dr. Pellerano founded Pellerano & Herrera, which has been the leading law firm in the Dominican Republic for nearly two decades and which is where he continues his successful private law practice. In addition, Dr. Pellerano has held a series of prestigious government and private appointments over the past half century (see below); from those positions, Dr. Pellerano has exercised significant influence on the development and modernization of the Dominican Republic’s legal system.

Dr. Pellerano is widely regarded as the leading Dominican scholar on Constitutional law and as a pioneer in the introduction to the Dominican’s legal system of the “Writ of Amparo” as a remedy for the protection of constitutional rights. He also is considered one of the country’s foremost experts in the litigation of complex cases.

In the course of his law practice, Dr. Pellerano has established and/or clarified Dominican Republic jurisprudence with respect to a wide variety of matters, including:

  • The first instance in which a lower criminal court’s verdict was overturned upon appeal on Constitutional grounds, which occurred during Dr. Pellerano’s 2001 defense of former Dominican President Salvador Jorge Blanco;

  • The definition of “Affectio Societatis” as a requirement for the establishment of a commercial partnership in the Dominican Republic;

  • Establishing the admissibility of appeals against arbitral awards;

  • The draft of the first Dominican bill recognizing commonhold ownership of apartment buildings, which was the key to the country’s real estate development; and

  • The country’s first successful distribution of liquidated assets on prorated basis of claims by multiple creditors.

The prestigious British legal publication, Chambers Global, has reported that Dr. Pellerano is considered the best known and most complete lawyer in the Dominican Republic, a “Lawyer of Lawyers.”

Dr. Pellerano also has been one of the country’s most influential educators in the field of law. In addition to being a highly respected Professor of Law in the country’s leading law schools (see below), he was the Founder and the first Executive Director of the Dominican Republic’s national schools for judges and for prosecutors.

Dr. Pellerano is the author of several books that have been, and that continue to be used, as textbooks in the country’s law schools.

  • Pellerano & Herrera Foundation, President. The Foundation conducts programs related to Pro Bono and Green initiatives. The Foundation also leads a program for an LL.M., Masters of Practice Law, in conjunction with the Dominican Republic’s PUCMM University, where graduated law students from all of the country’s universities apply for scholarships paid in full by the Firm. The LL.M. program is held at the Pellerano & Herrera offices, and students spend several hours working on actual cases.

  • Colegio de Abogados de República Dominicana, awarded in recognition of Dr. Pellerano’s valuable contributions to the legal sciences

  • Departamento Judicial de San Juan de la Maguana, awarded in recognition of Dr. Pellerano’s leadership of the National School for Judges

  • Universidad Autónoma de Santo Domingo, awarded in recognition of Dr. Pellerano’s books’ contributions to the study and development of the legal profession in the Dominican Republic
