Intellectual Property Rights Law in Dominican Republic

Sanitary Registration

The sanitary registration is necessary to import products into our country. The public institution responsible for issuing the sanitary registration certificates is the Ministry of Public Health.

In this order, the necessary documents for filing a sanitary registration in the Dominican Republic are:

  1. Name of the applicant and domicile;
  2. Specific name of the product and trademark certification in D.R. (simple copy of the certification of registration). Please note that is a requirement for the State Ministry of Public Health to have first the trademark registered;
  3. General information of the manufacturer;
  4. General information of the importer;
  5. Qualitative and quantitative formula of the product;
  6. Process of elaboration of the product;
  7. General information about the package characteristics;
  8. Five samples of the finished product in the way is going to be sold in the market.
  9. Label and/or packing of the product. Inserted, which must contain the following  specifications:

    1. Specific name of product;
    2. List of ingredients in descending order according to the percentage of them;
    3. Net content and narrow-hipped weight expressed in the units of the metric system   decimal, in terms of volume (liquid);
    4. Number of industrial and sanitary registry assigned by the authority of the country of origin for each product in individual;
    5. Name and address of the manufacturer, funnel, importer, exporter or salesman of the product;
    6. Country of origin. In agreement with the rules approved by the WTO;
    7. Identification of the lot of production;
    8. Labeled marked of date, day, month and year, will not be admitted in codes (date of manufacture and expiration)  and instructions of use and Conservation;
    9. Quantitative of ingredients; and
    10. Special Conditions of treatment in processes as they are: the use of ionizing radiations.

  10. Power of attorney duly signed and sealed by the applicant, also legalized by Apostille; and
  11. Free Sale Certificate, in original and in Spanish language, duly legalized by Apostille.

Furthermore, once the documents have been deposited, it is important to consider that the Commission in charge of the corresponding evaluation could reject the file in case they find some inconsistencies, which will be determined by their sole discretion. It is necessary to comply with their requirements.

The Trademark Legislation in the Dominican Republic does not prohibit commercialization or selling of the non‑registered products in the Country.  However, our National Health Legislation, which rules the importation and commercialization of medical and  non‑medical products in our country, establishes  that the selling, importation and/or distribution of products that do not hold their sanitary registration, which is granted by the Ministry of Public Health, are prohibited.
